1. General provisions

1.1. These general terms and conditions of sale (hereinafter the Terms) regulate the legal relationship between Fair Est OÜ (hereinafter the Trainer) and the client (hereinafter the Client) in the provision of training services via the website lonelypenguine.com.

1.2. The Terms apply to the purchase of all courses and services offered by the Trainer.

1.3. By placing an order, the Client confirms that he has read and accepted the Terms. 2. Description of the Service

2.1. The trainer offers various trainings, including:

  • online trainings

  • e-courses

  • contact trainings

2.2. The content, duration, schedule and price of the trainings are described on the website lonelypenguine.com.

2.3. The trainer reserves the right to make changes to the schedule and content of the trainings, notifying the Client of this within a reasonable time in advance.

3. Conclusion of the contract

3.1. The contract is considered concluded from the moment the Client:

has submitted an order on the website and

has paid for the training or received confirmation of payment of the invoice.

3.2. The Trainer will send the Client an order confirmation by e-mail.

4. Prices and payment

4.1. All prices are in euros and include VAT in accordance with applicable law.

4.2. Payment is made via the payment methods offered on the website or based on an invoice.

4.3. The Trainer reserves the right to change prices. Changes do not affect contracts that have already been concluded.

5. Participation in the training

5.1. The Client undertakes to participate in the training according to the registered time.

5.2. In the case of online training, the Client is responsible for the availability of the necessary technical resources (internet, computer, telephone, etc.).

5.3. The Trainer is not responsible for technical failures resulting from the Client's equipment or internet connection.

6. Right of withdrawal and cancellation

6.1. The consumer Client has the right to withdraw from the contract within 14 days from the conclusion of the contract in accordance with the Law of Obligations Act.

6.2. If the provision of the training service begins with the Client's consent before the end of the 14-day period, the Client loses the right of withdrawal from the start of using the service.

6.3. Conditions for withdrawing from the training:

  • up to 7 days before the start of the training - 100% of the paid amount will be refunded

  • 3–6 days before - 50% will be refunded

  • less than 3 days before - the fee will not be refunded

6.4. The trainer may cancel or postpone the training (e.g. due to a low number of participants or other valid reasons).

In such a case:

  • an alternative time will be offered or

  • the full amount paid will be refunded to the Client

  • 7. Liability

    7.1. The trainer is responsible for providing the service in accordance with applicable legislation.

    7.2. The trainer is not liable for indirect damages incurred by the Client (e.g. lost income).

    7.3. The trainer's liability is limited to the amount paid by the Client.

    8. Copyright

    8.1. All training materials, including videos, texts and presentation materials, are the property of Fair Est OÜ.

    8.2. Copying, distributing or disclosing the materials without the written permission of the Trainer is prohibited.

    9. Processing of personal data

    9.1. The Trainer processes the Client's personal data in accordance with applicable data protection requirements, including the European Union's General Data Protection Regulation (GDPR).

    9.2. Personal data is used:

    • to provide the service

    • for customer communication

    • to fulfill accounting obligations

    9.3. More detailed information is provided in a separate privacy policy on the lonelypenguine.com website.

    10. Dispute resolution

    10.1. The parties will attempt to resolve disputes through negotiations.

    10.2. If no agreement is reached, disputes shall be resolved in accordance with the laws of the Republic of Estonia.

    10.3. The consumer has the right to contact the Consumer Disputes Commission or use the European Union's online dispute resolution platform (ODR).

    11. Final provisions

    11.1. The terms and conditions are subject to the law of the Republic of Estonia.

    11.2. The trainer reserves the right to unilaterally amend the terms and conditions. Amendments will be published on the website lonelypenguine.com.
